Terms of Use

1. Agreement

These Terms of Use govern your use of the Near & Dear app and its widgets, provided by Zarzara. By downloading or using the app, you agree to these terms. If you don’t agree, please don’t use the app. The terms of the App Store or Google Play also apply to your download and purchases.

2. License

We grant you a personal, non-exclusive, non-transferable license to use Near & Dear on devices you own or control, subject to these terms and the rules of the store you downloaded it from. The app’s name, design, and code belong to Zarzara. The dates, notes, and photos you add remain yours.

Do not copy, resell, or redistribute the app, interfere with its advertising or purchase systems, or try to unlock paid features without paying. Restrictions on reverse engineering apply only to the extent permitted by law.

3. Free plan and ads

The free plan lets you save up to 3 dates, counted across your whole collection, including completed or archived dates. It includes ads.

Without a subscription, you can watch a rewarded ad to add one extra date. Each completed ad allows one addition, used when you save that date. It is not a permanent slot and is not a subscription. Ad availability depends on Google and your connection, and we can’t guarantee an ad will always be available.

4. Near & Dear Plus subscription

Near & Dear Plus is an auto-renewing yearly subscription that unlocks unlimited dates and removes ads. The price is shown in your local currency in the app and in the store before you confirm.

Payment is charged to your App Store or Google Play account when you confirm the purchase. The subscription renews automatically every year unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it anytime in your store account settings. Cancelling stops the next renewal. You keep Plus until the end of the period you paid for.

Refunds are handled by Apple or Google under their policies. Deleting the app does not cancel a subscription.

Your subscription is tied to your store account. You can restore it on a new device with the same account, but restoring does not restore your dates. A subscription bought on iPhone does not carry over to Android, or vice versa.

If Plus ends, nothing is deleted. You can still view, edit, and delete all your dates, but adding more than 3 requires Plus again or a rewarded ad for each extra date.

5. Your data and backups

Near & Dear stores your data only on your device, with no account or cloud sync. You are responsible for keeping backups, for example with the app’s export feature or your device’s backup. We are not able to recover data lost through uninstalling the app, device loss or failure, or system updates.

6. Your content and sharing

You are responsible for the dates, notes, and photos you add and share. Only add photos and information you have the right to use, and respect other people’s privacy when you share dates with them. Shared files are copies, so later changes don’t sync between devices.

7. Countdowns, widgets, and reminders

We work hard to keep countdowns accurate, but widget refreshes and notifications are controlled by iOS and Android and may be delayed, limited by battery settings, or change how they look on different devices. Near & Dear should not be relied on as your only reminder for critical, medical, legal, or financial deadlines.

8. Updates and availability

We may update the app and add, change, or remove features. We don’t guarantee that the app will be available on every device or operating system version, or that it will be uninterrupted or error-free.

9. Disclaimer and limitation of liability

To the extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind.

To the extent permitted by law, Zarzara is not liable for indirect, incidental, or consequential losses, including lost data or missed dates, arising from your use of the app. Nothing in these terms limits liability that cannot legally be limited, or your mandatory consumer rights.

10. Apple App Store

If you downloaded the app from the App Store, these terms are between you and Zarzara, not Apple. Apple has no obligation to provide maintenance or support and is not responsible for claims about the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple’s Standard End User License Agreement also applies where these terms don’t cover something.

11. Ending use

You can stop using Near & Dear and uninstall it at any time. Remember to cancel any active subscription in your store account. We may end your license if you materially breach these terms, subject to any notice required by law.

12. Changes and contact

We may update these terms when the app changes. The effective date at the top shows the current version, and continued use after an update means you accept the new terms. Your mandatory rights under the law where you live are not affected.
